The trial court dismissed 14-year-old Samantha Farb’s atmospheric trust case for “failure to exhaust administrative remedies” first. In its opinion, the court indicated that youth should first ask their government to take action before coming to court. In response to the court’s suggestion, Samantha pledged to formally petition the Kansas Department of Health and Environment to make rules requiring statewide reductions in CO2 emissions consistent with what current scientific analysis deems necessary to protect the lives and property of citizens, including future generations. Bob Eye, the attorney representing 14-year-old Samantha Farb, filed a lawsuit against the State of Kansas and the Kansas Department of Health and Environment in the District Court of Shawnee Country on the issue of whether the State of Kansas has an obligation to protect the atmosphere under the Public Trust Doctrine.
