On May 2011, with the support of Our Children’s Trust, Environment-People-Law filed atmospheric trust litigation in Ukraine to address the government’s failure to implement climate protection policies and to compel the development o fgreenhouse gas (GHG) emission reduction measures. On September 21, 2011, the court ordered the Cabinet of Ministers to prepare an assessment of the country’s progress toward realizing the goals of the Kyoto Protocol.

This case is different than Juliana because it challenges the government’s failure to address climate change and fulfill its obligations under the Kyoto Protocol, as opposed to a constitutional challenge to government policies that affirmatively cause climate change.
